KMPO Operations Management Request for Proposals

'Questions and Answers'


Q-1: On page 3, under 'Contact Information,' the deadline date for questions appears to be an error. Please clarify this deadline.

A-1: That date was an error.  The deadline for questions to be submitted regarding this RFP is July 23, 2009. This will allow time for KMPO to formulate answers and post them to its website by July 30, 2009, and give RFP responders adequate time to alter their responses prior to the August 3 submission deadline.

Q-2A: Has KMPO established a target budget for the requested services?

A-2A: No.

Q-2B: If so, could KMPO disclose the target amount, or provide an estimated range?

A-2B:  Bidders are encouraged to review KMPO project documents available on its website at www.kmpo.net in order to determine the scope of some of its past and pending projects, in order to determine the professional capabilities required to run KMPO operations.  In particular, the KMPO FY09 Unified Planning Work Program at http://www.kmpo.net/Data_Publications/upwp/kmpo-upwp-fy09-final.pdf provides a glimpse of specific project budgets, including a budget for MPO operations. However, bidders are encouraged to address the technical requirements of the RFP prior to concerning themselves with target amounts or estimated ranges of contract costs.  As stated in the RFP, award of the contract will be based on demonstrated competence, education, and qualifications for the services required at fair and reasonable prices, including background checks and professional and educational references.

Q-3A: The RFP document alternately refers to "proposals" and "bids." Under the "Proposal Content" section, there is no requirement for submittal of cost information, however the last paragraph of the RFP states "proposals shall be clearly separated into technical and cost sections."

A-3A: The Proposal Content section of the RFP is not a checklist and does not include all of the specific content required, because the structure and content of RFP responses are left to the bidder, except for structure or content required to be addressed from the RFP. However, bidders should understand that a response needs to adhere to the complete RFP in order for their bid to be considered completely submitted.  Specifically as to this question, the Contract Award and Agreement section of the RFP requires separate technical and cost sections.

Q-4: Will KMPO be following the qualification-based selection process described in Idaho Code section 67-2324 for this contract? 

A-4: No, because KMPO is not a public agency or political subdivision of the State of Idaho, so the requirements of Idaho Code section 67-2320 do not apply to its selection process as described in that Code.  Recognizing that KMPO is a creation of the federal Congress, and that KMPO has been recognized by Idaho in that regard, portions of federal law apply to its award of this contract.  Idaho Code section 67-2320 is mentioned in the RFP, because that code section, in addition to Title 49, Chapter 53 of United States Code, allows KMPO to avoid lowest bid award requirements for professional or construction management services, as long as other federal requirements are met related to qualifications of bidders, and the bid accepted is a fair and reasonable price for the services. Bidders are referred to pages four through nine of the RFP for determination of KMPO's bid evaluation and selection process.
